Terms and Conditions of Service

Kansas City Shoe Shine is pleased to provide shoe shine service to our customers, subject to compliance with and acceptance of the terms and conditions set forth below. Please read the following provisions carefully. Use of the Kansas City Shoe Shine service indicates agreement to be bound by the terms and conditions contained herein. If you do not so agree, you should inform us and cease using the service immediately.

This agreement is strictly between Kansas City Shoe Shine and its customers and does not in any way constitute or imply any relationship with any other parties.

Delivery Schedule:

Shoe shine pickup must be scheduled in advance by the customer. Pickup and delivery will take place each week on Monday through Saturday, except on certain holidays determined by Kansas City Shoe Shine in its sole discretion. Each customer is allowed one (1) pickup per month. Kansas City Shoe Shine reserves the right to determine the pickup and delivery times in its sole discretion and reserves the right to reschedule pickup and delivery times upon prior notice to the customer. Delivery will take place at least 24 hours but no more than five (5) days after the time of pickup.

Pick Up and Delivery, Procedure and Terms:

Kansas City Shoe Shine will provide the customer with bags and identification cards. Kansas City Shoe Shine reserves the right not to pick up items that are not in these bags, but may decide to pick up such items in its sole discretion. The customer agrees not to include any of the following that are in or attached to any of the items to be cleaned or inside any of the customer’s bags: (i) shoes that are not leather, faux leather, or suede, (ii) jackets, purses, or belts or (iii) any other items not meant for shining. The customer is responsible for any and all damage caused by any items left in the customer’s clothing orbag that cause damage to the shoes of any customer or any other property of Kansas City Shoe Shine or its customers. Kansas City Shoe Shine is not responsible for, and shall not pay for, any loss, damage or theft of items left unattended by the customer for pickup or delivery. The customer is responsible for ensuring that his/her Kansas City Shoe Shine bag is in the possession of a Kansas City Shoe Shine employee, and for initialing the pickup and delivery confirmation sheets unless otherwise instructed by Kansas City Shoe Shine.

Missed/Unattended Delivery or Pick Up:

If the customer misses a scheduled pickup during a given month, the customer will forfeit the service for that month and will not be reimbursed. In order to accommodate the customer for the missed month of service, Kansas City Shoe Shine will allow the customer to reschedule the pick up for that month within (14) fourteen days of the missed pickup date, and before the month ends, free of additional charges. 

Payment:

The customer must pay the agreed-upon charges prior to service. Services that have been paid for but go unused do not carry over from month to month or service term to service term. Kansas City Shoe Shine will not provide a refund for any under-utilization of services. Except as described in the next paragraph, all sales are final and all payments are non-refundable. In the event the customer's bag contains more than the maximum number of pairs oh shoes than their package stipulates, the customer will be charged $7 for each additional pair. The customer hereby grants Kansas City Shoe Shine the right to withhold the customer’s shoes until payment is made for the excess service. Kansas City Shoe Shine reserves the right to charge payment for excess service to the customer’s credit card on file if the customer does not respond, for any reason, within thirty (30) days of a good faith effort by Kansas City Shoe Shine to notify the customer that such payment is due, or if Kansas City Shoe Shine is not able to reach the customer within thirty (30) days.

Refunds:

A customer who has signed up for a monthly plan will have the right to cancel his or her contract within fourteen (14) days of signing up for Kansas City Shoe Shine service and receive a full refund.

After the first month of service, and after the initial fourteen-day period as described in the previous paragraph, customers may cancel their service at any time with no fee. Kansas City Shoe Shine shall have no obligation to refund any amounts paid by the customer, but it may choose to do so in its sole and absolute discretion.

Shoe Care:

Kansas City Shoe Shine will use reasonable efforts to maintain a high quality cleaning, shining, and shoe care service. Kansas City Shoe Shine accepts no liability for damage caused to shoes left unattended before pick up or after delivery at the specified drop-off location . Kansas City Shoe Shine will use their best effort to best match the hue of polish to it's corresponding shoes and accepts no liability for slight and natural coloration changes to the leather during the shining process. Kansas City Shoe Shine reserves the right to refuse to clean any pair of shoes. Kansas City Shoe Shine does not guarantee the removal of all stains, scuffs, or imperfections. Kansas City Shoe Shine will have its shining service re-shine items that, in its sole discretion, were not properly shined and have not been worn since they were shined. Kansas City Shoe Shine is not responsible for loss of or damage to any personal or non-cleanable items left in the shoes or bags such as money, jewelry, or any other item. The customer agrees not to leave such items in its shoes or in its bags.

Loss or Damage:

In the rare instance that your shoes are lost or damaged by Kansas City Shoe Shine, we will issue you a refund or credit for the value of that pair, taking into account the average life of the pair of shoes, depreciation for the age of the item, and the current replacement cost. If the customer is unable to document the age of a garment, the customer can attest to the age but Kansas City Shoe Shine, in its sole discretion, may limit the minimum age of any garment to one year. If no current replacement cost is available (e.g., because the item is no longer available in stores), Kansas City Shoe Shine may use the replacement cost of a comparable item currently available. Notwithstanding the foregoing, the maximum reimbursement for each individual item is $300. 

We are not liable for any preexisting damage to shoes. If we find any preexisting damage or have a concern about the colorfastness, or the age or weakness of the material, we will contact you to obtain your approval before proceeding to care for the item. If we are unable to obtain your authorization in a timely manner, then we may return the item without shining it.

Missing or damaged items must be reported to us within three (3) days of delivery of the item(s). If you believe that Kansas City Shoe Shine is in possession of an item but we have no record of its pickup, we request that you inform us immediately so we can start an investigation and you can search at home. If, after seven (7) days, the item has not been found, we may compensate you for the loss of the item in accordance with the guidelines listed above, at our discretion.

Disclaimer:

Kansas City Shoe Shine liability shall be limited to general money damages in a maximum amount not to exceed the charges for the term of service paid by the customer during the term in which the damages are alleged to have occurred. This liability shall be the extent of Kansas City Shoe Shine liability regardless of the form in which any legal or equitable action may be brought and the foregoing shall constitute the customer’s exclusive remedy. In no event will Kansas City Shoe Shine be held liable or be responsible for any consequential, special, indirect, incidental or punitive loss or damages, whether or not Kansas City Shoe Shine knew or should have know of the likelihood of any such loss or damages. Kansas City Shoe Shine disclaims all warranties, express or implied, with respect to the services rendered to the customer.
